Terms of Use

These terms govern your use of apps.flymedia.us (the "Site"), operated by Fly Media LLC. By using the Site you agree to them. They do not license any software — see Software licensing below for that.

The Site

The Site is provided for informational purposes. We may change, move, or remove content at any time. We aim for accuracy but do not warrant that everything here is complete or current.

Intellectual property

Site content — text, layout, images, and branding — is © Fly Media LLC unless stated otherwise, and is not covered by the software licenses described below. Product names and logos belonging to other companies are the property of their respective owners.

Software licensing

AppleTree

AppleTree is distributed through two channels, and which terms apply depends on where you obtained your copy:

• From the source repository. Licensed to you under the GNU General Public License v3.0. You may use, study, modify, and redistribute it under that license, at no cost.
• From the Mac App Store. Licensed under Apple's Licensed Application End User License Agreement, together with the App Store's own terms. Support and refunds for those copies follow Apple's policies.

Fly Media LLC is the sole copyright holder of AppleTree and licenses the same software through both channels. A copyright holder may license its own work on any terms it chooses; the GPLv3 grant remains fully in force for every copy obtained from the repository, and building it yourself is free permanently.

Trakam

Trakam is proprietary software. It is not open source, and no source license is granted. Copies obtained from the App Store are licensed under Apple's Licensed Application End User License Agreement, together with the App Store's own terms; support and refunds follow Apple's policies.

Trakam displays information read from Amtrak's publicly available live-map and schedule feeds. Fly Media LLC is not affiliated with or endorsed by Amtrak or the National Railroad Passenger Corporation, does not control that data, and does not warrant its accuracy, completeness, or availability. Do not rely on Trakam for travel decisions — confirm times, platforms, and disruptions with Amtrak directly. "Amtrak" is a trademark of the National Railroad Passenger Corporation and is used here only to describe what the app reads.

No warranty

The Site and any software offered through it are provided "as is," without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. AppleTree can move files to the Trash at your instruction — you are responsible for maintaining backups of anything you cannot afford to lose. Trakam reports third-party data that may be delayed or wrong — you are responsible for confirming anything you plan to act on.

Limitation of liability

To the fullest extent permitted by law, Fly Media LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Site or the software.

Third-party links

The Site links to services we do not operate, such as GitHub and the Mac App Store. We are not responsible for their content or practices, and their own terms and privacy policies apply.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules.
